The following is a list of selected achievements:

1. Impressive Victory Defending Intellectual Property

Defended real estate software company served with subpoenae seeking an overwhelming amount of electronically stored information containing trade secrets and privileged information. A criminal defendant aggressively pursued the issuance of those subpoenae by filing a request for them under seal, without notice, in an expedited ex parte proceeding. The results I obtained were impressive: the Court dramatically reduced the scope of the subpoenae, the costs of producing the information were shifted to defendant, the pattern of procedural delays in the case came to an end, and defendant’s case went to trial where he was convicted on all counts related to his theft of one million dollars.

2. Obtain Timely Favorable Settlement of Home Sale Dispute

Halted the sale of a key home to a client’s competitor because the owner of that home had already sold it to my client. Settled the matter on favorable terms within 90 days of filing the lawsuit: the competitor agreed to cease its pursuit of the home and allow my client to purchase it instead.

3. Protect Trade Secrets With Temporary Restraining Order

Obtain Temporary Restraining Order against a client’s former VP of Sales who was using trade secrets to solicit a substantial book of business after joining a competitor. Achieved a favorable settlement of the case within 60 days of filing it.

4. Timely Resolve Dispute Without Litigation

Represented a wholesale fish business in its dispute with a former senior executive who stole and mismanaged substantial funds. Performed timely analysis of extensive financial information that allowed senior management to efficiently move forward with its business plan without the costs and uncertainties of litigation.

5. End Serial Litigation Against Client With Jury Verdict & Judgment

Obtained a jury verdict and attorneys fees in a breach of contract and breach of consumer warranties case that put the plaintiffs into bankruptcy, thereby ending serial litigation against the client.

6. Quash Subpoenae Seeking Trade Secrets

Quashed subpoenas demanding trade secret and unpublished developmental validation information from biotechnology/life sciences company Life Technologies, Inc. (formerly known as Applied Biosystems and Applera). Protected trade secret and copyright matters involving DNA test kits and gene sequencing devices that use polymerase chain reaction (PCR) technology.

7. Efficiently Resolve Substantial E-Discovery Issues

When an opposing party in litigation propounds discovery requests concerning information found in millions of pages of electronically stored data containing privileged, trade secret and irrelevant information in a variety of file formats on different computers and electronic devices, I:

a.  provide analysis of the discovery requests and prepare written e-discovery responses and objections to the same;

b.  strategize on how to proceed in light of opposing counsel’s assertions, the e-discovery requirements of California’s Discovery Act, and the discovery burden that may exist because of the nature of the electronic information in question;

c.  gather data, documents and files through a combination of methods including search terms, analysis of indices, and document review; and d. process and review data with search tools and other software tools.
